MacGaze Terms of Service

1. Who you are agreeing with

MacGaze ("the software", "the app") is supplied by the operator of macgaze.com ("we", "us"). Contact: macgazesupport@gmail.com.

By downloading, installing or using MacGaze, you agree to these Terms. If you do not agree, do not install it.

2. What MacGaze does, and what it is not

MacGaze uses your Mac's built-in camera to recognise your face and, when it does, types your macOS login password on your behalf to unlock your Mac.

MacGaze is a convenience feature, not a security product. You must understand and accept the following before using it:

• It does not replace your macOS password. Your password continues to work exactly as before and remains the actual security boundary on your Mac.
• Webcam face recognition cannot measure depth. Unlike Apple's Face ID hardware, it has no infrared depth sensor. A high-quality photograph or video of you displayed on a screen may, in some circumstances, unlock your Mac.
• Face recognition is statistical, not certain. It may fail to recognise you, and it may in some circumstances recognise someone who is not you. This risk is not uniform: face recognition systems are documented to perform differently across different demographic groups.
• It stores your macOS login password on your device (see the Privacy Policy).

Do not use MacGaze on a Mac holding information where unauthorised access would cause you serious harm, for example a work machine subject to an employer's security policy, or a device holding others' confidential data, financial account access, or health records.

3. Licence

We grant you a personal, non-exclusive, non-transferable licence to install and use MacGaze on the number of Macs your purchased licence covers (one Mac for a single licence; three for a family licence).

You may not resell, sublicence, rent, or redistribute the software, or remove or circumvent its licensing checks.

Your licence includes software updates for two years from purchase. After that the version you hold continues to work; further updates may require a new purchase.

4. Trial

MacGaze is free to use for 14 days from first launch. After the trial ends, face unlock stops working until a licence is activated. Nothing else about your Mac is affected.

5. ⚠️ Consumer guarantees: your rights that cannot be excluded

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law where doing so would be unlawful.

Under the Australian Consumer Law, our goods and services come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

To the maximum extent the law permits, where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to (at our election) resupplying the software, or paying the cost of having it resupplied.

6. ⚠️ Limitation of liability

Subject always to clause 5:

To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with MacGaze, whether in contract, tort (including negligence), under statute or otherwise, is limited to the amount you actually paid us for your licence in the 12 months before the event giving rise to the liability.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, data, goodwill or anticipated savings, however arising.

We are not liable for loss or damage caused by:

• someone other than you gaining access to your Mac, whether through a false match, a photograph or video, or any other means;
• your macOS password being exposed, including by the software typing it somewhere other than the macOS lock screen;
• MacGaze failing to recognise you, or failing to run at all;
• changes to macOS that break MacGaze, including changes affecting the undocumented system interfaces it relies on;
• your use of MacGaze contrary to clause 2.

7. ⚠️ Indemnity

To the maximum extent permitted by law, and except to the extent caused by our own negligence, breach or wilful misconduct, you indemnify us against any claim, loss, liability, cost or expense (including reasonable legal costs) that we suffer arising out of:

• your use of MacGaze in breach of these Terms;
• your use of MacGaze on a device where you were not authorised to install it, or contrary to a policy binding you (for example an employer's IT policy);
• your enrolment of a face other than your own without that person's informed consent;
• any claim by a third party arising from your use of MacGaze.

8. Refunds

Refunds are provided only if MacGaze has a major fault, such as failing to recognise you at all after setup. We do not offer refunds for a change of mind. This is in addition to, and does not limit, your rights under clause 5.

9. Changes to these Terms

We may update these Terms. If a change materially reduces your rights, we will publish the change on macgaze.com at least 14 days before it takes effect, and it will not apply retrospectively to a purchase you have already made.

10. Termination

You may stop using MacGaze at any time by deleting it. We may terminate your licence if you materially breach these Terms, for instance by redistributing the software or circumventing its licensing. On termination you must stop using the software and delete it.

11. ⚠️ Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.

Note: if you are a consumer outside Australia, mandatory consumer protection laws in your own country of residence may apply regardless of this clause, and this clause does not attempt to exclude them.

12. If a clause fails

If any part of these Terms is found unenforceable, that part is severed and the rest continues to apply.
